Found this courtesy of BBJ's post re. the President of TF stepping down.

This is interesting that 1-800 is using intimidation against one small shop for bidding on certain keywords, 1-800 somehow feels only it has the right to. Am I reading this correctly?

Does anyone know anything about this?

Cambridge, MA - Flowers, LLC and manager Hur Guler have been sued by 1-800-Flowers.com, Inc. for alleged trademark infringement. (case number 2:2011cv01038 filed in New York Eastern District Court) 1-800-Flowers claims that the defendant has engaged in trademark infringement by bidding on various keywords and purchasing sponsored ads using various search engines, Google, Yahoo and Bing.

It is Flowers, LLC's position that consumers deserve the right to choose between any number of floral delivery options, and that placing a sponsored ad, which in no way uses the Plaintiff’s trademarks, does not constitute infringement. A recent decision by the 9th Circuit Court of Appeals (Network Automation, Inc. v. Advanced Sys. Concepts, Inc.) supports Flowers, LLC’s position. Through the O’Connell Law Office, in Arlington, Massachusetts, Flowers, LLC intends to defend its position on its own behalf and on behalf of each other advertiser seeking fairness in the marketplace.

Yes, you read it right, I've known about this for a while. Funny thing tho, Flowers LLC is not a flower shop, just a bad OG...

It appears they are turning on themselves... LOL

I'm actually in a war of words with Hur Guler on another BBS... too funny!

I looked at the website for www.flowers.com or www.flowers.ma it appears to be a FTD owned site. Has pic of FTD del van, open 24 hours, only an 800 #.
It does show an address but looks like it might be a drop box location, unit #100.

Wouldn't that be nice, them turning on each other?

They are hiring all the time for telecommuting phone answerers....I don't know today, the whole talk about the indutry is getting to me..right now I am not very fond of wire services, ogs or even many of my fellow florists..I was told twice this week that super small florists should exist nor should we have any imput in business conversation because we are not like real businesses....not in so many words but I am telling you...some days I could take this industry and knock all their heads together 3 stooges style...I don't usually have sucha thin skin, but today I have had enough of all of the silly ass antics all around..

This is definitely an OG, no flower shop for these guys, just a website, or maybe multiple websites.

FTD does not own the sites, they do host them... here's his FTD site (well one of them) FTDfloristsonline.com/flowers One has to wonder why FTD would condone the marketing on this site...
 
Melissa ~ It's a save the local florist group on facebook. If you have a facebook personal page someone from the group can invite you if you like. Warning it can be very toxic.

It can drag you down, I check it twice a day and spend no more than about 2 minutes on it. Another group "florist" seems to be a little better, business discussions without the "fingernails on chaulkboard"......
 
sorry for hijacking, Melissa, I didn't smack them...I said my peace and when it went there I have no use for that kind of unprofessionalism...Lori, I find that at night when everyone starts drinking their wine or whatnot it gets to be like a circus...so I think I will stay away..

As for this thread, It is pretty bad when the og''s start sueing each other, you really know competition is getting feirce, unfortunately that does not bode well for us florists, because we will never ever be able to compete with this stuff, not because we can't learn but because most of us wouldn't want to bother with all of this kind of nonsense...somedays, I really have hope and others my hope is deflated like a 4 day old helium balloon and I get so sad at what greed is doing to the only job/business/career I have known or loved...: (

For now Rick...until they let in florists with attitude and sharp tongues..If it is a good group, I hope they put the brakes on some of the flareups that do and can happen...I know save has been removing some posts but has mentioned he does not want to babysit..I think that board will eventually implode..I hope today is a better day...
