Class Action Suit against FTD and/or Teleflora?

FTD and Teleflora are ignoring their contracts and comments to their original base, the Real Florist who use their wire capabilities and logos. They both require a Real Florist to have a "bricks and mortor" location, display coolers, a delivery system, the ability to design a sellable floral product and more.

They, however, are not requiring, 800Flowers, ProFlowers, BloomsUSA, Wal-Mart, Big Box Grocery Stores and other order gathers to meet those same requirements to use the same wire capabilities and logos.

With this in mind, it is time for Real Florist to take them (FTD and Teleflora) to task. This can be done through a Class Action Suit in the Federal Court System filed against both of them (FTD and Teleflora) for violating Real Florist existing and perpetually perceived contracts.

Please respond to the poll above as to your willingness to join such a suit or not. Understanding that taking this poll in no way commits you to any final action on your part, but would give an indication as to the possibility of such a suit.

Rod, I believe that both of them changed their "requirements" a few years ago especially when they courted 800Flowers. The only thing I believe you can get them on are the false listings by their order gatherer members who do not blatantly state on their sites that they are NOT located in the town they are listing in. There is a rule regarding that. They have been told repeatedly by me and others regarding this.
Considering that Weasley Berry shows up in my town as a "Master Florist in Millinocket" (a blatant lie) in their google listings and show an FTD logo really perturbs me, but nothing was done about it.
In my resignation letter to FTD, this was one of my complaints at the top of a long list as to why a 30+ year member was through with them. When I was called from headquarters asking what it would take to keep me in, I asked about the top three points, none were negotiable, therefore, I remained resigned.
I agree, there should be a fine point to get them on and in the past, the brick and mortar, display window, proper refrigeration and delivery vehicle were requirements. I believe you will no longer find them pertinent in the new rules and regs.
 
Attorneys I talk to say that they (FTD/Teleflora) can change the rules for new members but that older members, say 10-15 years, aren't bound by these changes, "perpetually percieved contract" is the key. These "perpetually perceived contracts" were never agreed to by both parties.

Hey i sent the same letter to FTD three years ago. They did call me as well and I told them get rid of the OG!!!!
 
I spend countless hours trying to find the right way to proceed with dOG and WS issues.
I think FC members know it and I know for a fact that WS people know it.

The class action thing is a good idea but the time is not right, though it is close on the horizon, with SUPPORT !

Being a minority, we are limited, and they all know it, however, things are changing, and will afford us an opportunity in the near future, but a loaded gun, without a trained shooter, will result in failure.

Build the movement, educate the consumer, send the letters to the appropriate agencies and become thorns in their sides and watch the changes.

Cash cows, as we all know we are, have more power than we realize, and the same tool that destroys us is available for our use. We only have to have the guts to utilize the tools, and many will not !

Turning to Teleflora may just be the right move, at the right time, for the right reasons. Let them be the first to attack the onslaught of the drop shippers and set the stage for the future !
They can be the ones to make a difference, and today I offered myself up to orchestrate " what could be ", in an industry of floral professionals.
If they refuse to be a part of the solution, then we re-evaluate and move forward, but refusal, could, and will, place a primary competitor on top, so why would they ?

Kudos on your thoughts and goals Gilliand !

Time will tell, and the clock is ticking !
