FTD and ProFlowers Settle Lawsuit

In the settlement, neither party admitted to the allegations contained in the claims brought against each other and no money will be paid by either side. The settlement includes a compromise in which FTD agreed to dismiss a separate trademark action brought against Provide Commerce, and in return Provide Commerce agreed to make certain modifications to future advertising. The parties also mutually agreed to abide by certain other guidelines in their advertising after December 31, 2006.
Not much in the way of details. Would love to know the 'guidelines' on advertising. Am guessing the Dec. 31 date is due to ads already in the can.

Since both are now focused on direct shipment of flowers, is anyone surprised?
 
Just further proof that the whole thing was just a big publicity stunt to get both corporations names out before V-day/M-day...if you cared to look at the original thread on this matter pretty much everything I predicted came true. The whole dumb thing was a total non-issue...a "campaign promise" to make all the FTD drones feel that the mothership was REALLY going to bat for them.

The sooner most of us understand that its really little-guys (mom n pops/small business) vs. big guys (corporate giants), NOT big guy v. big guy (they all vacation on the same islands and belong to the same country clubs and private schools), the sooner you can start taking control of the direction and marketing OF YOUR BRAND, not someone else's.

Whew! Geez Cathy I saw myself teetering on the edge there...better back off the coffee...

Guess the main question will be whether they both will be advertising 'fresher from the grower than you florist' flowers. :(
Well to beat BlowFlowers, maybe they can advertise "Picked in the fields for your order?? HAH! We now DIG them up and keep them alive as they are sent overnight, each flower transported by our specially trained group of horticulturists in a hermetically sealed bag devoid of any greenhouse gases created by evil Republican policies!"

That's still not true though. 1-5% of us florists order direct from the farm. Maybe I can sue PF next. ;)
 
It is interesting to look at Proflower's site. The have a a phrase TM'd that says. "The art of freshest flowers" Even grocery stores don't try and claim that their flowers are fresher than a florist. Also interesting that on the "florist express" page of Proflowers site, they refer ti US as the "professionals".

I don't think you can win the war who has the FRESHEST flowers. It is merely a adjustive. FTD and Proflowers are going to "duke it out" as to who has the freshest farm direct product. Florists can't win there. I think florists are better off to stress that THEY are the PROFESSIONALS and and know what to do with the flowers. If the consumers want to send "do- it -yourself flower kits", we can't stop them, but should start using that term in our ads. Professionals deliver your thoughts and feelings completely assemblied.. WE don't deliver YOUR gift as a do it yourself kit in pieces. It needs work, but hopefully you get the idea.

Everyday Flowers A Small Flower Shop. Will Be fileing a lawsuit against FTD And Provide Commerce, Inc.

The Lawsuit Claims That FTD And Provide Commerce, Inc Are Both Advertising That Their Farm Direct Flowers Are Even Fresher Than What Comes From The Fields. They Claim That The Flowers Actulay Are Grown In The Card Board Boxes That They Are Shipped In And Grow While They Are Being Shipped.

Everyday Flowers Has Decided To Drop the Lawsuit Against FTD And Provide Commerce, Inc. The companies have reached an out of court settlement that includes some exchange of some inflated stock and a supply of some type of hybrid rose that Everyday Flowers Will Begin Testing In Its location during this years Mothers Day Week.

Its been a game for a long time now.

Little bits of information floating around designed to uplift members hopes in a company that has only one goal in mind. So many are dependent on the bread crumbs that are being left on the trail only to find a wolf at the end of the trail ready to eat.

Be ready for the battle for the next holiday season. These companies are partners and they don't need us anymore.
