does justflowers.com pop up in the paid listings at the top?

When I google my shop name, just flowers pops up with my shop name in their title. Is that legal and is there anything I can do about it? I have had 2 customers call me this week who thought they were on my website.

just wondering if anyone else has dealt with this and if I can handle it through the search engine companies or if I need to get a lawyer involved

Jamie,

When I googled, the sponsored ad IS justflowers. But it does not have your whole name as the second part, just killian, not killian daisy. Is Killian a town or is it your own name? Since they are not using "Killian Daisy Florist", I don't know if you have a leg to stand on.

I am not an attorney of course, and as far as I know google allows use of even trade-marked names. If Killian is NOT a town, I would most assuredly contact an attorney and have them send a cease and desist letter, Eric and CHR both have received them from FTD basically ordering them to use negative keywords in their sponsored ads.

Jamie, Several times I've had a business lawyer look into the same matter with me. Both times I spent $500 and came away with nothing. I'm no SEO guy, but they buy all the paid links, ads and then put a portion of your name in the ad (legal). I've been told the only time I can go after them is if they use my name or your name in it's entirety.................Last time, lawyer did say "It should be class action time".........................no gas in the tank for that one............

Killian is not a town name it is the name of my shop. I was thinking class action as well, actually. You know that they do this with a ton of shops

Here in Canada for me you come up first.

When I do "Killian Flower" you come up 3rd. There's another one in another state.

I believe there are town names Killian (isn't one in TX?)
