A friend just gave me a "heads up" from the Just Flowers website.

The important information is:

New York Affiliates: The State of New York has recently passed an unfair sales tax law, so until it is overturned, we are no longer able to have or accept affiliates from the state of New York as of June 1, 2008.


This is New York's well-known "Amazon" law that requires out-of-state marketers to collect and remit SALES TAX on orders sent to NY state.


Isn't it too bad that an OG has to pay sales tax just like REAL NY FLORISTS!

What do they consider an "affiliate"? Is it a wire service member or shops they utilize with a credit card or account?
 
As I understand it, an affiliate is a third party that allows Just Flowers to place an ad or link on the third party website.

For example, assume Joe's Pizza in NYC has a website with a Just Flowers Ad on it. If Joe's customers click through to Just Flowers' website and buy something, Joe's Pizza gets a commission on the sale. According to Just Flowers' website, the commission can be as much as 18%.

I am not too sure what would be considered unfair to them about charging sales tax.

Would this type of legislation apply to the guys you are fighting in NC as well?

It's "unfair" because they can't continue to sell "TAX FREE" in competition with REAL NY FLORISTS.

My opinion is that no new legislation is required. The DOGS already have a nexus in NC, and all that is required is for the Revenue Folks to go after them.
