The Preferred Florist bankruptcy filing lists hundreds of florists nationwide who are owed as little as $26 to as much as $66,000.
Ouch.

The bankruptcy does not appear to include Lower Forty Gardens, Meola's company that buys the remote call forwaded phone numbers.

I'd like to know what will happen to all those phone numbers and listings? Could another dOG sweep in and snap them up?

I think I gotta place a call today - nope just tried about 10 numbers I found on the web in various cities and area codes and they all ring disconnected - I bet he had a gaggle of numbers.

I've spoken to a couple florists he owes money to, none that were owed that much, but some that are in the 10K range....

And on the numbers Jon...my guess would be *thousands* of numbers...heck... 11flowers.com has *hundreds* as I was told yesterday.

I would suggest that his method of operations are no different than Enron, etc. Many of those dollars that are owed to florist and others are now in his personal account protected from his corporate bankruptcy. A small time thief will go to jail, but a corporate thief using bankruptcy, will continue to reap the rewards of stealing from others.
 
Also - Chapter 7 is for a reorganization. Chapter 13 would be for a liquidation so it appears he will try and regroup.
But can't the judge change the type?

I mean, once **all** the evidence come to light....

Actually, for a corporation, Chapter 7 is liquidation
Chapter 11 is for reorganization.

For personal bankruptcy, Chaper 7 is liquidation and Chapter 13 is reorganizationh.

One thing that needs to be addressed is his overall corporate structure; i.e. is his whole empire going down or not? Likely, since corporate & personal veils are easily pierced.

WRT the class action law suit in Missouri ...

Depositions were scheduled for this week. They have been put on hold to ascertain where things should go from here. Will keep you posted.

Meola & Intent to Defraud

Would it not be reasonable to think that in anticipation of what was about to happen he began building his warchest, thus premeditatedly continuing to accept and send orders to unsuspecting florists, with no intention to pay ?
Gee, that sounds like a crime to me !

A good friend of ours suggests that as he continued in business and owes so much to those same " unsuspecting florists ", he has crossed several new lines and should therefore be subject to state and federal prosecution.
As he is filing Chapter 7 ( Reorganization ) he will try, but should be unable to wash the florist debt if it is proven that he intentionally engaged in fraudulent activity, or the intent to defraud.

The burden now lies with our politicians and lawmakers and ultimately all those ( florists ) that this master of deception has impacted in one way or another.

Our source suggests that all parties. whether financially involved or
with something to say, ( a vested interest in our industry ), should take the time to write their elected officials "demanding a thorough investigation and prosecution if warranted ".

The outcome of the Meola cases can and will impact the furure of the industry. If he wins, everyone loses, as many like him, and many more to come will follow in his footsteps.
If however the justice system finally takes a hardball approach,and that snowball starts rolling down the hill, it will be impossible to stop, thus paving the way for the future.


In our opinion the whole thing should be getting nationwide media attention, and it's not. How do ya figure ?
That just says that enough people are not taking the time to write letters and make calls.

Read the NJ article very, very carefully. Meola has taken Two (2) of his many companies into Chapter 7 bankruptcy (Liquidation). the TTP Inc (aka Flowers with Gifted Elegence) and the preferred Florist Network. These are al least 2 of the entities that were being sued in the most recent class action lawsuit.

He also lists $$$$ that are owed to HIM personnally and HIS WIFE by both companies. They are creditors now, just like everyone else.

This snake has not folded his tent and he is not dead. Only a small part of his body has been chopped off.

He has bought himself about 8 to 12 months with the bankruptcy system......unless a lot of pressure is brought to bear.

Write your letters....to congress, to the NJ Bankruptcy Court, and to the FEDERAL PROSECUTORS IN NJ. And Keep writing!!!! He knows how to play the system, and he is playing it now.

PS: David L stated that the corporate & personal veils can be pierced, and they can. However, ti takes time,,,,,lots of time.....and research.......and persistance and the attention of lots of "interested parties". Feed the Feds and the Bankruptcy courts any and all information that you have. If you are a PFN member, make sure that you get and file a claim. The court system needs to know how bad this really is. !!!

If everyone wants to see action then action is needed.
Write those letters and make your elected officials listen.
The more that call and write, the more attention the big picture will get.

There is no way this guy is going away. It's just a ploy to fight the lawsuits. These guys have tons of interlocking companies each with different purposes. After things quiet down you will be surprised to learn that one of his other companies has acquired the phone numbers, and the orders will start flowing again. He's put in way too much time and effort to just give it up.

He's not going away Ted. You are absolutely right on that one, and he is a very cunning individual, but is he cunning enough to escape unscathed ? I think not, not this time around.

If everyone with an interest in him and others like him turn up the heat during what just may be a golden opportunity, inevitably someone will not only have to listen, but will have to investigate and take action.
The power to make it all change lies within and to be honest with you, we here in NY have become thorns in a lot of peoples sides over the big picture in the last few months, and have brought much attention to the lack of attention given to it from our elected officials.

What's that old saying ? Nothing ventured, nothing gained !

Just my humble opinion.
