OK, so this is a little tongue in cheek, but I thought it something to ponder. Several assumptions were made prior to hatching this gimmick, a couple being, that we may never kill the Order Gatherers, and perhaps our best chance is to remove the profit from their side of the biz.

Another is, that after fighting with Just Flowers for two days over the same order they tried to get in my door, once on the Merc and 3 more times on the phone, I wondered if I could actually profit from their orders if they were to be looked at as an order collector, working on my behalf to get me the order and not any other florist here in town. And the fact, that I now have the ONLY Mercury system within 20 miles, and that if they want to send orders into Midland, they will either have to use me or another florist in another city (no profit for them with todays gas prices).

I have attached a "NON-Florist Order Fulfillment Contract" for your perusal and thoughts. I know many here will make the argument to just say no, so yes, I am being the devils advocate on this (remember I said tongue in cheek in the beginning) but I was bored this morning. Lets try to stay away from the old arguments, and look at this in a new manner, even though we know it may not be in our best interest to proceed in this manner, lets try (just for the sake of argument) to look at a way to profit from these scum bags, under the assumption that they will never go away.

Let'r rip.....

Very interesting. Provocative. Creative. I'm eager to see where the great minds (really!) on this board will take this.

Very interesting. I lean to the direction that they are not going away either. You could very well get away with this in your situation. Also at the holidays as well.
We also have had call after call attempt after attempt to get an order through. They are always willing to give more $ at that point. Great food for thought.

Mark....you ARE a troublemaker in deed!!
With the ONLY operating Merc in the city, why even ponder this wonderful idea!!:headbang:
I think that you'll find great damage done to your integrity, and well being by proposing this "contract" between yourself, and the flower scammers.:thumbsup
I totally think that approaching an order scammer with this type of contract could NOT possibly hold up in court, or in the eyes of the law, in the event that there is a chargeback, or perceived non-fulfillment.:icon15
Why would you even BOTHER going down this road??:grovel:
I think NO ONE HERE would EVER "contemplate" such an "agreement"!!:yourock:
Can I JOIN YOU??:smoke

First, I think your idea is better tahn some...You are atleast looking in a positive direction and saying OK they are here and not going away what can I get out of them. However, the contract between you and the OG will not be seen or known about by the sender and therefore will be like skimming the possibly already skimmed order. Now you have people spending 75.00 for a possible 25.00 arrangement. Who loses here? It is not the OG's name on that very small order, is it?

On the other hand, I did work one place where we routinely took 20% off the top for OG orders only and never got one complaint...but how much damage went unsaid is the real question???

I do like to way you are thinking, but I believe that what has to happen is all florists must go up on all prices by 25% nationwide and then fill ws orders to that value and give our loyal everyday customers a 20% discount everyday for using a local florist. They will feel special and we will get what we despeartely need to do business. Furniture stores do this and they have all the money in the world to advertise... This may be the only way to level the playing field...

I like the fullfillment charge.

A quick inquiry alerting the OG that there will be a charge assessed to the order would be an interesting excercise.

In other words a $50 order will be filled at $37.05.

The hard part would be to get that info to customer. Letting them know that their OG derived order won't be filled to full value because of the "extra costs" associated with processing OG orders might work.

Hmm....

How about an Inquiry to the OG asking for the customer's address and phone number!!!!! ;)

Nah, it won't happen.

Joe

Joe, I too thought of the demand for their customers information prior to fulfillment... but did not think that would fly.

As to your $37.05 price....

I was proposing that I would fill the order at $50.00, but that they would be charged at $66.95, since their actual collection is (like) $70.95 ($50.00 flowers + $12.95 Service Charge + $8.00 WS Rebate) on a $50.00 order, thus netting them a $4.00 (1/2 their rebate) net gain per order.

This would give the recipient a nice $50.00 arr (what the consumer paid for the flowers) and remove the profit ($12.95 and rebate) from the OG, but still allow the consumers need to be satisfied, the recipient to get flowers, the OG to remain in biz (if not profitable) and allow us to fill the order at a profit.

Mark, I would split out the Delivery charge separately, from the cost of the flwoers or order, so that you AALWAYS get a delivery charge....They collect it, they should pass it on.

Your idea of No charge backs if placed in a cc will not fly....it voilates both state and federal consumer protection and federal credit card laws.

other than that....go for it!!

Regards,
Cheryl

I like your way better.

Let us know if any go for it..You being the only FTD shop with a mercury would be in a position to try it. You may be onto something When you explained how you wanted to charge them more it made more sense. How will you know they didn't slough off the charge onto their customer?? Because you know they are quite good at that game..

Let them know............

How about adding a card with the delivery, such as

Note to Recipient: Due to added third
party service charges and fees, your
order may not be filled to full amount
paid by your gracious sender.

Then hope the recipient will call the sender and ask what charges and fees were added.

I sure wish Griff was here right now. OK I'll do it for him.:spankmecu

It is funny that you brough this idea up Boss as the dOG Just Flowers tried to get us to do a fruit and snack basket for today.....and we told them it was too late to get the fruit and all for todays delivery....and they said that they had been trying for two days to get the order though as this was suspossed to go out two days ago. We told them.....Oh well !! We could not do the order till Monday at the earliest and we would need an upgrade in dollars.

Mark,
Seem I can open the document on my work computer and will try to send it at my home computer.
I have said a few years ago that we should charge a MONTHLY membership fee to these people if they want us to fill their orders.
I will say that when the ball is in your court and it should always be....play it to your advantage.
Like I said many times before, the other florist in my town likes to fill those orders...when she is too busy, I get to fill those 100% local orders she can't fill.
SHe joined FTD at $99.00 a month all inclusive, she only used them to receive.....
Her husband, is a bank manager. You would think he would be able to figure things out....
