Funny how many I have seen before both in my TF and my FTD selection guides. I'm not going to bother counting how many but it's loaded with them.

Are you a member of either of those wire services?

Do you believe in software piracy? How about copyright protection? Who's ripping who off here? I think you're stealing copyrighted images from people who pay for the use of them.

nope...took them off the selection guide that was mailed to me by TF or FTD, don't remember which, when we were members.

I guess I'm busted now...great job Detective Bloomz. Better call the wire police on me...I'll prepare my family for my imminent departure to copyright prison, where I'm sure Bubba has something waiting for me <sigh>

...and it was *such* a sweet crime...just think, only about 2 billion potential witnesses!

You know, I *was* a member of BOTH those SCUMMY wires, and was ripped off so bad by them with outright lies and financial losses that I have *no* problem using those images until I feel I don't need them anymore. I MORE than paid for the right to use the images, and feel no guilt whatsoever offering the same arrangements at a much lower price point.

Paybacks a b*tch, right?

P.S. Want another little secret? I tear the tags off my mattress too...
 
So Mark - you're calling others unethical and basically dishonest (skimming - ripping off, etc) yet you don't apparently feel you need to be honest?

I am not the type to "turn someone in" but I suggest you click here and do some reading as you are quite obviously in material breach of copyright restrictions and subject to legal action. I have a friend who just recently was sued for not taking the logo out of his window when h quit and his settlement was 73 grand, after incurring a bunch of lawyer fees to go with it. They have a legal department.

When you quit either wire service you lose the permission (or license) to use their images. A quote you may want to read, since you seem to think you have some kind of right cuz they sent you a cd - when you were a member. Read on...

A. GRANT
This Agreement when signed by both You and FTD confirms FTD’s grant to You of the right to obtain and use the Images in accordance with the following terms and conditions:
10. Use of the Images shall be immediately terminated:

b) in the event your FTD Membership is terminated or suspended, or you are put on probation;
c) upon request of FTD for any reason, with or without cause, and FTD shall have no liability for such termination.

B. PROPRIETARY RIGHTS TO CONTENT
You acknowledge all the content of the Images, including but not limited to text, trademarks, copyrights, software, audio, photographs, video, graphics, and other material contained in the Images provided to you by FTD are exclusively owned by or licensed to FTD. You therefore agree to use this content only as expressly authorized by FTD.

C. MODIFICATIONS TO AGREEMENT
You agree, during the period of this Agreement, that FTD may: (1) revise the terms and conditions of this Agreement; and/or (2) modify or terminate the use by you of the Images provided under this Agreement at any time. FTD shall not be liable to you or any third party should FTD exercise its right to modify or discontinue the use of the Images. Any such revision or change will be binding and effective immediately on: publication in FTD’s Newsletter or Clearinghouse Statement Message Center; posting on the Mercury Network; or notification to you by e-mail or United States mail. You agree to review FTD’s announcements, including the Agreement, periodically to be aware of any such revisions. If you do not agree with any revision to the Agreement, your only recourse is to immediately discontinue use of the Images and not FTD. You may terminate this Agreement at any time by providing us with notice by e-mail addressed to [email protected] or by United States mail addressed to Marketing Department, Florists’ Transworld Delivery, Inc., 3113 Woodcreek Drive, Downers Grove, Illinois 60515. Notice of your termination will be effective on receipt and processing by us. You agree that, by continuing to use the Images following notice of any revision to this Agreement or change in the Images, you agree to abide by any such revisions or changes

FTD Wins Trademark Suit

FTD, www.ftdi.com, has won a trademark infringement ruling against former florist member ***** Flowers Inc. FTD filed the action in 2002 "for past due amounts owing and infringement due to their continued use of FTD marks after the corporation had been terminated from FTD membership," FTD says.
FTD sought "treble damages," or triple damages, of $777,462, asserting that ******* had gross revenues of $259,154 from sales made between October 2002 and October 2003, when (defendant) was illegally using the FTD trademark, according to an Aug. 25 article in the Intellectual Property Litigation Reporter. (Treble damages are intended to punish the guilty party and discourage others from similar behavior, according to www.legal-explanations.com.)
An Oregon judge found ****** and his two guarantors of obligations and debts liable for damages resulting from the FTD trademark infringement, according to the story. When the case was settled this summer, FTD says it received a total sum of $70,197.41 to cover damages and attorney fees and also a summary judgment "enjoining (the defendants) from using FTD marks."

Be Very Careful

Mark, JB is very right on this one. Be careful,very careful your ignorance (I did not say stupidity) of the law and FTD's actions. They do protect that logo, and anything affiliated with it. You forfit ALL RIGHTS when you quit. They may have sent you the cd however read the fine print and copyright on CD.

Don't take me wrong here, because I know what they did was not kosher. But if they received 260,000.00 in sales, that they say, and they owed money from before they even quit($). Now they have to pay back 70,000.00, and I'm sure they had other expences. If I'm reading this right?

Those are better odds then you'll get in Vegas. I'm sure there is more to it?????

I obviously hit a deep-rooted nerve in your religion of OG-based bliss...and since when did I become FC's "Fearless Leader"?? If any of you are allowing yourself to be "led" by someone like me, you are in very deep trouble.

You didn't "question" me, you insulted me repeatedly without logic. I gently asked you to stop enough times, quite politely. I even tried a very polite PM to you. Enuf was enuf.
