Many of the online OGs -- including Teleflora -- do not charge sales tax on their orders. As a REAL FLORIST, I am required by state law to charge sales tax on the same transactions.

Does anyone have some ideas on how we can try to deal with this situation?

Teleflora, just flowers, ftd are not florists so they don't have to charge sales tax. Because you are a florist, you fall under the rule where the sending florist collects sales tax, but the receiving florist doesn't.

Frankly, I don't see anyway around this unless you can get the ruling reversed that said the online OGs are not florists--and good luck with that.

One possibility, is that online transactions represent a huge opportunity for states to collect more taxes. Given that most states are hurting for money, it probably won't be too long before they find a way to tax every online transaction. I guess that levels the playing field.
 
yes I remember when some OG in California argued that they where not florist. So that they didn't have to charge sales tax.

However they keep claiming to be your local florist.

I think this is the only thing that we could work on. If the OG doesn't want be considered a " florist " so they don't have to collect the sales tax then they should not be allowed to use the term florist in any type of advertizing.

On another note this is another reason not to fill for OG or Teleflora.com FTD.com and 1800flowers. Since they are competing against you and using the leverage of not charging sales tax to get the orders away from you.

You maybe able to move some extra product for the mean time but eventually your going to put yourself out of business. Just like the 7 shops that have closed their doors in the last 6 months.
