Hmmm... if florists refused to play with OG's or greedy wire services, wouldn't they just die? (the OGs and WS not the florist, I mean)

something to think about!

I am raging, but not surprised.
Just disappointed in myself that I did not realize before that FTD charges us a Mercury acceptance fee
-$1.25(?) - even when we refuse an order.

Even if the sender cancels it, you still pay. The only way to waive the fee (TF does the same) is to FORward it.

I don't think this could possibly be legal - not when we receive orders for under our listed minimums, or for product we are not codified for, etc....

I have to disagree with people who have said 'once you signed the contract, you're done.'

I think you might have a case. Here's why (I'm not a lawyer, though).

My understanding is that we can always file a claim against "unreasonable charge", unless we explicitly agree to it. When we sign a contract with FTD, we didn't explicitly agree that we WILL pay any unreasonable charges. For example, many bank charges (all those stupid late fees) have been contested in court.

Class action? No chance. Been there, done that. The reason is money. Class-action lawyers don't take a case in which the total recovery would be less than millions. The only way we can file class action is to go through governments, like FTC or state attorneys. I doubt they would be interested in going after a small potato like FTD.

But we have successfully complain and get a whopping $2.50 back, when Justflowers kept sending us the same exact orders that we had already rejected. Since then, we asked them to remove us in their filler's list.
