My friend, annmariesflowers, needs our help. Teleflora wants to take her to court for unpaid bills. Was just notified of 2 days ago of cancellation of account. Got phone call from TF lawyer today saying will take 3 payments to make lawsuit go away. They won't settle for lesser amount.
She's at her wits end. This is beyond by scope of knowledge. I know you guys and gals can help her. She hasn't been voted in yet. She will be watching for posts on this. Youse guys are the best.
 
First thing she needs to do is see a lawyer. This happens to good people everyday. She needs to get a lawyer to place a call for her. Most lawyers will give a free consultation and if she has one that is a customer of hers even more the better. She needs a lawyer and NOW!!!!!
 
sHE NEEDS TO GET A LWYER!!! i AM GOING THROUGH HELL WITH THIS SHARK LAW FIRM! I have gone as far as filing a FTC complaint with them and my next step is to file a police report for telephone harassment. These people are AWFUL!!!!!! She can call me if she wants 708/361-2223. Even if you are making good faith payments to them they call and yell at your staff, call you at home, call your neighboring stores (ald tell them WAY too much). Their tactics absolutely can not be legal! I finally hired a lawyer to get them to back off. I would rather pay my lawyer than their BS 25% that they tack on to whatever you owe Teleflora. This whole experience has been HELL and I would do anything to never see anyone else go through it!!!!!
 
There sure has been a lot of talk about Teleflora lawyers in recent threads. I remember there was discussion about a similar case in another thread a couple months ago. It might be worth a search.
 
Getting a lawyer is sound advise, however, when their lawyer calls again, ask him/her to repeat their "offer" of 3 months and it will "go away", and have it on speakerphone, making sure the "lawyer" knows that he/she is being overheard by MORE than just you!!
Then, just say, "see you in court"..."let me know when you have it set up" and get your ducks in order!!
You are being "blackmailed" into believing that the person at the other "end" is actually from a law office.
Make sure you "document" the lawyers NAME, in full, where they are calling you from , with THEIR "local" phone number, fax #, email address, AND exact address,town,and zip.
Then, contact TELEFLORA...TELL THEM THEY WILL ONLY receive what is "owed them", and NOTHING else...IF they wish to proceed to court, THEN you WILL dispute the ENTIRE AMOUNT owed, and DO NOT make ANY kind of restitution, until ALL documents are sent/faxed/notarized to such an agreement from BOTH the "so called lawyer" and TF HQ.
Often you'll find, these calls originate in "collector offices".
Do NOT be "embarrassed" to challenge them...do NOT be embarrassed to ask for help!!
 
She needs a laywer ASAP. The money she owes, she should pay it. Then they can only bring up the disputed amount.

TF and FTD (not sure about 800) have an agressive law team just waiting to squeak out the money of the cancelling florists.

When we decided to cancel FTD (our bill was current) we had sent a message through the merc (that is what customer service said to do). We got no reply. Sent another one 2 weeks later. No reply. 2 weeks later, called and was told we missed the deadline.

I ended up speaking to a supervisor and they told me the cancellation policy was listed in the directory on page 26. I asked them why only there and nowhere in the membership packet nor on merc. They didn't have an answer for me. I told them that we had better be cancelled immediately and we weren't going to pay another dime. I told them there is no way this is going to fly with a small notation in a book that is not used by shops with technology and conveniently left out of the membership packet and the merc. I also spoke with our local rep and between the two of them, we never heard anything from them again.
 
Like I said in a earlier thread, it is sounded more like a collection agency than a lawyer office.

I would get a lawyer and go from there.
I would also either deposit in trust with your lawyer payment for the invoices owing. If it have to take a while than do it.
Like someone said, make sure you gt their names address etc etc
It is not going to be a easy battle I am sure, but with a lawyer at your end this may stop all of these call.
I would also if I was in your place, not sign back up with teleflora. I would make sure I go on my merry way and do not look back when things have settle.

Amy I might need a piece of advice from you soon. Looks like I'm also going to end up in court with FTD because I refuse to pay them for certan things. (like my POS system is down for almost a year and they refuse to do anything about it, but still charge me maintenance I'm not sure what they are maintaining. ) And they always refer to somekind of "contract" that they wouldn't show me for whatever reason I only have a copy of "change of ownership" when I bought the shop.) To be hones I wouldn't mind the court, because they will HAVE to provide the contract there.
 
Do you think we could find a lawyer that would help all of us. I cancelled
FTD per the book and on time for the March deadline. It has fallen on deaf ears until last week, when I asked the sales rep how my cancellation was coming and he said he would have his boss call. He called offering me $99. membership for 6 months and don't forget I have a POS which will be due and payable. I told him he could apply all my reciprocity fees to the POS system as they are well over a 110 per month. I guess we are all in for a fight to get rid of them.

Some she owes and some is in dispute.

If I was a TF lawyer, I would be popping champaign right there. She knows she owes money. Great. If your buddy knows she owes at least some of the money, then she must pay. Sorry, I have no sympathy. I am a TF member, so I am partly paying for the time of TF lawyers, the time that could be saved if she just paid.

Right on - but it's tough to hire a lawyer and spend more than the bill. Not only tough but self defeating.

Pay what you owe and let it rest - they'll likely drop it unless its a gadzillion.

Even their lawyers don't work cheap.
 
Am I incorrect in understanding that they can't refuse any amount you can afford to give them?

That being said, what Mike said makes the best sense to me.

I was the one that brought this up in March. I still have not paid them. When they called in April I told them not to call me again until they had a corrected bill in their hand.
I owe $476 and am more than happy to pay that. Not $1200. Especially not $1200 without any documentation of what it's for.
Same woman called again last week, asked me to fax her the check. I told her I would not do that until I got my corrected bill.
I feel like I'm on a merry-go-round.
I've called Teleflora repeatedly asking for a correct bill, they keep telling me 'since it's in the lawyers hands, we can't do anything...'
Well you know what? I can't either then.
Call me stupid, call me what you want I don't care. I don't owe the money and I'm not paying 3 times what I owe.
Threaten me all you want.
I'll keep you posted.
If I do anything, it will be what Luc recommended. Just have a lawyer hold the funds for me - until one of their REAL lawyers calls.
 
you all need to be friends with a collection agency guy. I have a great friend in the collection biz. just a phone call to him and he can tell you immediately what an agency can and can not do.

If you use an agency for your bounced check, bad accounts, give them a call. I bet they would be able to give you some guidance.

Dave Ramsey has some advice too. Check his web site.
