I see it as similar to the issues raised in this lawsuit that accused Intel of bullying customers out of using competing products. Intel's offices were raided shortly afterwards.

Try making a reservation at Hilton and having them say, "Did you stay at a Marriott during the last month?"
"Why?"
"Because we'll assess a $5 surcharge."
"Well I didn't, but I stayed at a Holiday Inn. Are you still gonna charge me?"
"No, we are only penalizing Marriott customers."

If they did you could opt not to make the reveservation. Ryan and the other duel members also have a choice to pay or not to pay.
