This link will take you to a PR release that Flower Hut's PR firm sent to the media in North Carolina as well as interested "other" media such as CPA and TAX type websites.

Will it do any good? I don't know, but I think its better than wringing my hands and crying, "ain't it awful!" while the florist business implodes nationwide.

Bill, great work. I will forward this to the reporter at the Asheville Citizens Times to add to all the other information that he has already received from me about the situation that is affecting all florists. Hopefully, this will light the fire under his arse that he seems to need. Hopefully, every other florist in North Carolina on FC will help themselves too.

If other states become aware of this loss of tax revenue, this could become the start of some huge industry wide changes.

Phone books and web sites.....exploding and robbing us blind....thanks for the good work, and I got an order from bloomnet this morning , looking like a florist sent it....sending me on a 40 minute round trip for a 45.00 total...basic any thing I wanted to make arrangement.. however...take out near an hour of driver pay and minimum 2 and a half gallons of gas...and their 27 percent divided up by monthly charges...and not worth it.....so as I rejected I decided to google the phone number...and this is what I got...http://www.weddingsolutions.com/janis-flowers-gifts-10441319.html
and look at the service areas....can we say OG ...anyway ya all might wanna check some of the orders your getting from what appear to be florists.....thanks again for the info here am reading and looking to whom I can send it now...think I am gonna start by calling some of the local phone book companies who print the stuff....

Just left a meeting with one of our local elected officials regarding Bill's Press Release and some other pertinent info we threw into the mix regarding the overall levels of deception prevalentl within the industry.
He was interested !

Just a suggestion, part ours and part his :

What would it take for all of us, today, October 21st, to send a copy of Bill's Press Release, to all of our local, state and Federal representatives ?
Aggressive move, yes , but maybe just the right move to get people in government talking.

Our rep is of the opinion that a national flooding of the Press Release may just catch our elected officials off guard, thus forcing them to taken a careful look at the claims of deception. To arbitrarily ignore a large effort would be senseless.

We have just sent to every elected official from local through Federal that we had contact info for with a brief attached cover letter asking that they also forward the information as they see fit.
We hope that everyone else can take a moment today to do the same.

If something comes of it..GREAT, ........if not,.........we tried !

Update on our end

Our local politician is investigating and will personally contact the county, to see what can be done on the local level, to include the drafting of legislation, and he will personally contact the NY State Assembly and the Senate. He as stated before is very interested and has been a real go getter here for many years.
Contacted Congressman Tim Bishop this afternoon and copies sent to the NYS AG's office. Additional copies forwarded to various news reporting agencies including Newsday, News12LongIsland, Reuters, CNN, FoxNews, WNBC, WABC, WCBS, MSNBC etc..... In total close to 100 copies were forwarded out of here today.

A key aspect of this is the establishment of "nexus."

That is the basis of the "Amazon ruling" in New York. And I believe there is additional basis for a NEXUS in NY by major OGs.

Please read on.

In NC, I am a member of both FTD and TF and receive Wire Service products and services from both of them that are being TAXED in accordance with NC Sales Tax percentages. I was told by both TF and FTD that this was, in fact, NC sales tax.

BUT, NEITHER FTD nor TF are charging NC Sales tax on orders from OR to NC destinations.

Late last week I received a phone call from an Investigator with the NC Department Of Revenue. We had a long chat. During this conversation, I asked if a merchant had the right to choose its NEXUS. In other words, could a merchant choose to charge sales tax to one class of customers, but not to another.

Like TF and FTD are doing,

The Inspector thought about that question four -- or maybe five -- microseconds before he replied that such a choice was not a merchant option.

LOTS of uncollected sales taxes appear to be lying on the table in every state where OGs are collecting sales tax from one class of customers but not from another. And this is true whether the State has a local anti-OG law or not.

Thanks for the heads up! I came across the article last week, but didn't see the potential ramifications. I check our Manitoba laws, and it would appear that we have the same requirements here. I also did some checking on a few of the guys that appear on Yellowpages.ca for Winnipeg. None of them are charging Provincial Sales Tax. In fact some are still charging the higher National Sales Tax that was reduced in January.

Suggestions for us Canadians to proceed?

I have had another idea that could use some discussion.

I am now working with a local MLA and the Retail Council of Canada on this issue. It is part of a much larger issue with the internet overall, but I have convinced them that our industry is a good place to get the ball rolling.

I am also suggesting another piece of legislation that would require final totals to be provided for online sales PRIOR to entering credit card information. My OG research has been hindered by this, because I am not going to enter my credit card information before I get a total. (Sorry guys)

I think this legislation would help in may ways, and is universally applicable to internet sales.
 
I think our efforts are best spent lobbying and educating the consumer than trying to network ourselves with the same failed business model of the OG and WS. The association on Facebook could accomplish goals such as those mentioned here. Anyone who wants to take our industry back, please let me know I will get you to the group that is working that goal.
