Yes, we did. We researched it right away as soon as the Fahey family called and new something was wrong. We reported it to Teleflora but accomplished nothing. Since then I've called Teleflora several times asking to speak with my local rep (who I've never met and have been in business at the same location for 3 1/2 yrs.)
 
Gosh I can't imagine Teleflora letting someone like this in their network... can you :)

Not to pick on TF alone, FTD and FSI are no better...seems that BMT is the only one looking before they sign 'em up... of course 800F is an OG as well, and it's not really in their best interest to have their competition in their stable....

I had no idea this was in the works. From the newspaper's description of the law, it doesn't go far enough. FlowersSentToday is not using a fictitious name, and they are not forwarding from a local phone number. But they are flat out lying as to them serving a local area.

Our MIchigan law doesn't have much teeth either. They must list their address; heres one for you: SC., CA where is that? Some OG's are blatent and don't even list where they are located.

Please tell him that FTD Florists need to maintain decent profit levels (which are hard to do these days) and FTD can help by minimizing their fees and keeping the cost of products, services, and technology as low as possible. "Junk" fees, like the Quality Assurance Fee, need to be eliminated because they cause a tremendous amount of ill will towards FTD and because we are being charged for something we see little return on.

How did you get his ear?
 
I think the damage is done and there is not much that can be done to reverse the effects.

Lowering the prices on the overall service really wouldn't be an issue if the product was sold at the correct value.

I wish I had an idea that could really help but I don't
 
Considering that FTD is now spreading their Quality Assurance Fee with FTD University-give me a break....how many florists are going to use this (I'd love to know the percentages of small flower shops with internet connections, from my polling of shops, the numbers are few). They can't be bothered to send their employees to certification classes, design shows, and seminars-will they let them do the "university classes" at work on their pay time??
Another dumb charge is that doorstop we pay for when the shop already has a cd delivered for their pc. Opt out considerations should apply to all their "extras".

Class-action lawyers won't take cases involving only small fish like Wesley Berry, because their fee is at minimum hundreds of thousands of dollars. At least that's what I was told. My conclusion, which my lawyer also agrees, is that I need to make a class-action case that involves a bigger fish.

Nope. I know a lawyer who currently has a class action lawsuit againt a guy named Tom in New Jersey. You likely might figure out who this is. This case only involves florists in Missouri.

A class action that could be brought here is on a major scale - likely all of the larger florists throughout the entire US.

Perhaps this should be considered.

And a large issue is that there is no way to 'opt out' well they say there is a way but the link never works and no phone or email is returned..
I wonder if this is a way to get them.. They use our names without permission.. no way to opt out,.. must break some FCC law or other. Perhaps even the 'bait & switch' one which seems the law most prosecuted by the FCC.. who is it that has a lawyer on retainer?? this might be a great class action suit.

I don't know how we can get the FCC really involved but if we could, the WS could be brought into it because they turn a blind eye on these scammers.. maybe even facilitate them.. and using our money (dues) has to constitute at least a breach of the fudiciary laws??

It seems we can not reach the big guys at the Ws with common sense and fair play.. could we do it by bringing this all out into the public..it would hurt all of us..but maybe it would be worth it to clean up everyone's act and reclaim an industry that used to be worthwhile and honorable.
Skimming and curtailing are both against the written rules of all the WS.. they just chose to ignore them to get the big guys to send orders.. but this might be a way to start it.. We would need copies of original orders given to a skimmer and copies of the resulting merc or dove or 800fl order to the filling florist.. but that would constitute unrefutable proof in a court of law that the consumer was defrauded.. and that should be taken seriously by the FCC.
Well folks I finally did it! I got my shops information removed from all of Wesley's sites. Here is what I did. I went into my Dove system and looked up Wesleys real contact information. I had my law firm draft him a letter demanding to have all of my informatin removed from any and all of his websites. It took a few days but he took my shops name off his sites.

Now most of you will probably cringe at the thought of hiring an attorney to write a letter since they charge anywhere from $100-$300 per hour. You don't need to pay that much. On a previous post I told you about a legal plan that you can get from Pre-Paid Legal services. I can't say enough about the service. You can access a top law firm in your state for a low monthy fee. Among many other things, they will write letters on your behalf for situations just like this. I encourage everyone to do the same. Don't wait for a class action suit to happen because it might not. Take action gang! It doesn't do any good to complain on these message boards if you don't take action. It's going to take all of us to make a difference, not just a hand full of people. Lets shut down the OG's and Skimmers.

You can get a legal plan for about 1 or 2 dollars per day. Ask yourself, how much money do you lose on a daily or monthy basis to the OG's and skimmers? Then ask yourself if you could hire a top rated law firm to keep on your staff full time for 1 or 2 dollars per day to handle these types of legal issues wouldn't you do it? If you need an attorney but can afford their regular fees check out this site.
