I had no idea this was in the works. From the newspaper's description of the law, it doesn't go far enough. FlowersSentToday is not using a fictitious name, and they are not forwarding from a local phone number. But they are flat out lying as to them serving a local area.

Considering that FTD is now spreading their Quality Assurance Fee with FTD University-give me a break....how many florists are going to use this (I'd love to know the percentages of small flower shops with internet connections, from my polling of shops, the numbers are few). They can't be bothered to send their employees to certification classes, design shows, and seminars-will they let them do the "university classes" at work on their pay time??
Another dumb charge is that doorstop we pay for when the shop already has a cd delivered for their pc. Opt out considerations should apply to all their "extras".

Class-action lawyers won't take cases involving only small fish like Wesley Berry, because their fee is at minimum hundreds of thousands of dollars. At least that's what I was told. My conclusion, which my lawyer also agrees, is that I need to make a class-action case that involves a bigger fish.
Well folks I finally did it! I got my shops information removed from all of Wesley's sites. Here is what I did. I went into my Dove system and looked up Wesleys real contact information. I had my law firm draft him a letter demanding to have all of my informatin removed from any and all of his websites. It took a few days but he took my shops name off his sites.And a large issue is that there is no way to 'opt out' well they say there is a way but the link never works and no phone or email is returned..
I wonder if this is a way to get them.. They use our names without permission.. no way to opt out,.. must break some FCC law or other. Perhaps even the 'bait & switch' one which seems the law most prosecuted by the FCC.. who is it that has a lawyer on retainer?? this might be a great class action suit.
I don't know how we can get the FCC really involved but if we could, the WS could be brought into it because they turn a blind eye on these scammers.. maybe even facilitate them.. and using our money (dues) has to constitute at least a breach of the fudiciary laws??
It seems we can not reach the big guys at the Ws with common sense and fair play.. could we do it by bringing this all out into the public..it would hurt all of us..but maybe it would be worth it to clean up everyone's act and reclaim an industry that used to be worthwhile and honorable.
Skimming and curtailing are both against the written rules of all the WS.. they just chose to ignore them to get the big guys to send orders.. but this might be a way to start it.. We would need copies of original orders given to a skimmer and copies of the resulting merc or dove or 800fl order to the filling florist.. but that would constitute unrefutable proof in a court of law that the consumer was defrauded.. and that should be taken seriously by the FCC.
